Terms & Conditions - SMS Campaign

These SMS Terms & Conditions apply to text messages sent by Modal Infrastructure LLC, doing business as Modal, “Modal,” “we,” “us” or “our,” in connection with access to Modal pods and related services.

These SMS Terms supplement Modal’s Pod Terms of Service. These SMS Terms apply only to Modal’s text messaging program. In the event of a conflict regarding access to or use of a Modal pod, the Pod Terms of Service will govern.

1. Program Description

Modal may send transactional text messages to users who provide their mobile phone number and consent to receive SMS messages from Modal.

Messages may include:

  • pod access codes

  • one-time authentication codes

  • entry instructions

  • account or booking notices

  • security-related notices

  • service updates relating to pod access or availability

  • customer support communications related to pod access

Modal’s SMS program is intended for transactional and operational messages. Modal does not use this SMS program to send marketing or promotional messages unless you separately consent to receive marketing messages.

2. Consent to Receive Text Messages

By providing your mobile phone number and opting in to Modal’s SMS program, you agree to receive text messages from Modal at the mobile number provided.

Consent to receive text messages is not a condition of purchasing goods or services, except where SMS delivery is required for the specific access method you choose.

You represent that you are the account holder or authorized user of the mobile phone number you provide.

3. Message Frequency

Message frequency varies based on your use of Modal pods, account activity, access requests and service-related events.

4. Message and Data Rates

Message and data rates may apply to messages sent to you from Modal and to messages you send to Modal. Please contact your mobile carrier for details about your messaging and data plan.

5. Opt-Out Instructions

You may opt out of receiving SMS messages from Modal at any time by replying STOP to any Modal text message.

After you reply STOP, Modal may send one final confirmation message to confirm that you have been unsubscribed. After that, you will no longer receive SMS messages from Modal unless you opt in again.

You may also contact Modal at info@modalpods.com to request removal from SMS messaging.

Please note that opting out of SMS messages may prevent Modal from sending you access codes or other messages required to use SMS-based pod access. If you opt out, you may need to use another access method, if available.

7. Delivery Not Guaranteed

Mobile carriers are not liable for delayed or undelivered messages. Message delivery may depend on your mobile carrier, network availability and other factors outside Modal’s control.

8. Privacy

Modal’s collection and use of information in connection with its SMS program is described in Modal’s Privacy Policy, available at:

Modal does not sell mobile opt-in data or share SMS consent information with third parties or affiliates for their marketing or promotional purposes.

9. Changes to These SMS Terms

Modal may update these SMS Terms from time to time. The updated version will be posted at this page with a revised effective date. Your continued use of Modal’s SMS program after changes are posted means you accept the updated SMS Terms.
