If payment is required, payment information may be collected and processed by our payment processor. Modal does not store full payment card details unless expressly stated at the point of collection.

3. SMS Privacy
Modal uses SMS to send transactional and operational messages related to pod access and related services.
Modal does not sell, rent or share mobile opt-in data, mobile phone numbers or SMS consent information with third parties or affiliates for their marketing or promotional purposes.
We may share SMS-related information with service providers who help us deliver text messages, manage consent, provide customer support, operate access-control systems or maintain our services. These service providers are permitted to use the information only to provide services to Modal or as otherwise required by law.

Service Providers
We may share information with companies that provide services to Modal, such as SMS delivery providers, access-control providers, payment processors, website hosting providers, analytics providers, customer support tools, security vendors and professional advisors.
Site Hosts and Business Customers
If a Modal pod is located at a third-party site or operated in connection with a business customer, we may share limited information with that site host or business customer as needed to operate the pod, address security issues, investigate misuse, support users, confirm service usage or meet contractual obligations.
Where practical, Modal may share aggregated or de-identified usage information rather than personally identifiable information.

We may disclose information if we believe disclosure is necessary to comply with law, respond to legal process, enforce our agreements, investigate fraud or misuse, protect safety or protect the rights, property or security of Modal, users, site hosts or others.

Opting out of SMS may prevent you from receiving access codes or other messages required for SMS-based pod access.

You may contact us to request access to, correction of or deletion of certain personal information, subject to applicable law and our need to retain information for legal, security or operational purposes.
Marketing Communications
Modal does not use its transactional SMS access-code program for marketing unless you separately consent. If Modal sends marketing emails or other marketing communications, you may opt out using the unsubscribe mechanism provided in those communications.

Depending on where you live, you may have rights under applicable state privacy laws, such as the right to request access to, correction of or deletion of personal information and the right to opt out of certain uses or disclosures of personal information.
